The Internal Revenue Service (IRS) released Notice 2013-71 which modifies the use-or-lose rule for health FSAs offered under a cafeteria plan. Pursuant to this guidance, beginning in 2013, employers are permitted, but are not required, to include a provision in their cafeteria plan that allows up to $500 of unused health FSA funds to be carried over to the following plan year.

The Supreme Court of the United States ruled that section 3 of the Defense of Marriage Act (DOMA) is unconstitutional. They concluded that section 3 of DOMA “undermines both the public and private significance of state-sanctioned same-sex marriages” and found that “no legitimate purpose” overcomes Section 3’s “purpose and effect to disparage and to injure those whom the state, by its marriage laws, sought to protect.” The guide highlights this decision.
