Technical Bulletin – 2015 Issue 2 – EEOC Issues Proposed Rule on Employer-Sponsored Wellness Programs

On April 20th, the Equal Employment Opportunity Commission (“EEOC”) published a proposed rule that would amend the regulations and interpretive guidance implementing Title I of the Americans with Disabilities Act (“ADA”). This proposed rule is the first formal guidance that the EEOC has provided since 1991 and, in general, provides guidance on the extent to which the ADA permits employers to offer incentives to employees to participate in wellness programs.
