Technical Bulletin – 2015 Issue 8 – EEOC Proposes Regulation Applicable to Employer-Provided Wellness Programs

On October 30, 2015, EEOC issued a proposed regulation that would amend prior regulations implementing Title II of the Genetic Information Nondiscrimination Act (“GINA”) as it relates to employer-provided wellness programs that are or are part of a group health plan. The proposed rule provides new guidance on the application of GINA’s rules when spouses or other family members are eligible to participate in an employer-provided wellness program.
