Federal rules and regulations relating to benefits – from ERISA to COBRA to Cafeteria Plans – apply broadly and dive deep into detail.

Federal regulations, however, pale in comparison to the speed of release and scope of application of regulations related to the Patient Protection and Affordable Care Act (“PPACA”), which are released at a dizzying pace. Jurisdiction by three different agencies adds to the difficulty in accessing guidance because each agency houses guidance on different websites. However, one website contains regulations issued by all agencies with jurisdiction for implementing PPACA.

When seeking a PPACA-specific rule or regulation, please use the Federal Register’s healthcare reform-specific site at the following link: https://www.federalregister.gov/health-care-reform.  The site collects the varying forms of guidance, such as notices, proposed rules, final regulations, etc. related to PPACA.  The site also has a search customization feature that will prove helpful when searching for a specific rule or regulation.
