Technical Bulletin-Supreme Court Decisions on Same-Sex Marriage Have Far Reaching Impact on Employer-Sponsored Benefits

In a landmark ruling, the Supreme Court, ruled Section 3 of the Defense of Marriage Act (DOMA) to be unconstitutional, effectively changing the definitions of “marriage” and “spouse”, for purposes of federal law, to the definitions set by each respective state. On the same day, the Supreme Court also issued a ruling in the case, Hollingsworth v. Perry, holding that the supporters of Proposition 8 did not have standing to defend the initiative before it. Both cases are discussed, as is the impact on health and welfare and retirement plans resulting from the Windsor decision.
